successfully represented ‘JJ’ in ‘JJ’
and others v Secretary of State in which the House of Lords
held that an 18 hour form of house arrest under a control order
was an unlawful deprivation of liberty contrary to art 5 of the
ECHR. The House also gave important rulings in linked appeals on
other aspects of the control order regime. This is the first case
to reach the House of Lords on the Prevention of Terrorism Act 2005
which was passed after the House of Lords held, in A,
X, Y and others v Secretary of State [2004] (the ‘Belmarsh’
case) in Mr Manjit S. Gill QC
also represented X and Y, that indefinite detention of suspected
terrorists was incompatible with art 5 of the ECHR.
