Qualifications: LLB (HONS)
Background
Gina was called to the Bar in 2002 having practised as a Financial
Advisor. Following her call to the Bar, Gina ran a busy Immigration
Department for 3 years and was the instructing lawyer in the test
case of R(D) and R(H) v Secretary of StateCO/2106/2004, Asylum seekers
from the new Eastern European Union countries who won permission
to bring a High Court challenge against the governmentäs decision
to block their state benefits.
Areas of practice:
All aspects of Family and Children work, Asylum and Immigration,
Asylum Support, Human Rights, Employment, Nationality, Social Security,
Public law, Contractual Disputes. Gina has been involved in cases
which concern a link with family and Immigration law, particularly
Wardship proceedings and High Court Inherent Jurisdiction. As Ginaäs
practice develops in Family Law, she will be looking to expand in
other areas of family law, particularly those with an international
flavour such as international child abduction. In Asylum, Gina has
a particular interest and expertise in representing trafficked children,
and in cases involving vulnerable female individuals, specifically
focusing on gender guidelines. Gina also practises in the Administrative
Court in Judicial Review matters and has experience of obtaining
telephone injunctions out of hours in immigration matters.
Gina recently assisted Manjit Gill QC and Ramby de Mello in relation
to the marriage case R (on the application of (1) MAHMOUD BAIAI
(2) IZABELA TRCINSKA) (Claimants) v SECRETARY OF STATE FOR THE HOME
DEPARTMENT (Defendant) & JOINT COUNCIL FOR THE WELFARE OF IMMIGRANTS
(Intervener) [2006] EWHC 1454 (Admin) under the Asylum and Immigration
(Treatment of Claimants etc) Act 2004) involving EU law and ECHR
law.
